RENTAL TERMS & CONDITIONS

Damage Waiver & Cleaning Fee: This non-refundable fee is charged on every rental. This covers garments for cleaning & non-malicious damage while in your possession. It does not cover loss or damage that is beyond repair. Replacement costs will be charged & are due immediately upon return if any item(s) are deemed lost or damaged beyond repair by J. Alan Formalwear. A replacement price list is available upon request. A return copy of this form is proof that items were returned, it does not release the renter from responsibility of damages or stains.

Personal Property: It is the responsibility of the customer to check that all personal property is removed from the garment pockets & bag prior to return. J. Alan Formalwear cannot be held responsible for any personal items left in the garment bag or pockets.

Final Fitting: While J. Alan Formalwear will attempt to correct any sizing issues within our ability, if you do not attend the scheduled final fitting on the delivery date, J. Alan Formalwear cannot be held responsible for ill-fitting garments. Rushed orders & orders picked up after the scheduled delivery date may limit our ability to correct any issues. J. Alan will correct all “out-of-town” measurements, within our ability, as long as all requested measurements are submitted complete & timely. No one other than J. Alan Formalwear is allowed to alter any garments. Customers who alter any item, in any way will be charged.

Style/Size Changes: Style changes may only be made by: the renter of a single order or the group administrator of a group rental. All style changes must be made a minimum of 14 days prior to the event to avoid a $25 change fee (per order, per item). If an item is changed to a higher priced item, the difference will be charged in addition to the $25 change fee. By signing and initialing the rental agreement form the customer acknowledges the styles have been reviewed with them by a consultant at the time of ordering & are correct as ordered.  If a customer chooses to be measured earlier than suggested, or requests a certain size for an item, or is missing any sizes requested for an “out of town” order, any size changes needed at the final fitting will be charged a $25 change fee per item.

Cancellation/No-Show: Orders cancelled for any reason, at any time, will forfeit the $40 down payment for sizing & clerical fees. Orders with a total cost less than $40 will not be refunded if cancelled. No refunds will be given for any amount paid if the order is cancelled within 7 days of the event, or if the order is not picked up. Any amount over $40 will be refunded if cancelled prior to 7 days before the event. Cancellations may impact group rate prices & the group administrator will be notified prior to any change for approval. Any refunds due will be returned to the credit/debit card used or in the form of a check payable to the customer’s name on file & cannot exceed the original amount paid to J. Alan Formalwear. (Minus the non-refundable damage waiver & cleaning fee and/or sizing fee.)

Rush Orders: Orders placed within 7 days of the event date will be charged a $20 rush fee. Orders placed 2 days before the event date will be charged a $50 rush fee. Any order placed for a Saturday delivery date will be charged a $60 rush fee. Rush orders must be paid in full at the time of order, cannot be changed & are non-refundable.

Return Policy: All returns are due back on your scheduled return date. By signing the rental form, you acknowledge that you are aware of the return date & fees involved with late returns. If your garment is not returned on the scheduled date or is missing items, you are responsible for any charges to replace lost items & any late fees incurred. Late fees are $30 per day. All payments for late/damaged/missing items are due immediately. If replacement cost is paid for a missing item(s) & is later returned, in good condition, within 5 days, a refund will be given, minus a $10/day late return fee.

 

RETAIL POLICIES

*Return/Exchange Policy: We will exchange merchandise within 14 days of purchase date. You must present your original receipt, the merchandise must be unworn, unwashed, unaltered, undamaged and have all tags attached.  Due to the nature of our business (rental and retail) merchandise taken from the store may not be able to be returned, only exchanged.  All approved returns are subject to a 10% restocking fee.  Specially ordered items and altered items are not returnable and non-refundable unless faulty. If you want to claim that merchandise you purchased is faulty (excludes alteration services) you must do so within 3 days from the date you received the merchandise from the store. If your product is deemed damaged or faulty by a designated J. Alan Formalwear, Inc. consultant, we will offer you a repair or exchange as appropriate.

*MERCHANDISE NOT PICKED UP (“ABANDONED MERCHANDISE”): 120 days (4 months) after your recorded event date (the date you gave J. Alan Formalwear, Inc. for your wedding, prom, occasion, etc.) or 180 days (6 months) after your recorded order date (the date you purchased or ordered your items), if you have not picked up merchandise for which you have paid in full (including free groom suits & tuxedos), that merchandise will be considered abandoned. If the merchandise has not been altered (see return policy regarding altered items above), J. Alan Formalwear, Inc. may (at its discretion) offer you the option to be credited for such merchandise less administrative costs. Otherwise, your rights to the merchandise will terminate. During the 120 or 180 day period after your recorded event date or order date, J. Alan Formalwear, Inc. will attempt to contact you by phone, email and/or postal mail to request that you pick up your merchandise. If you are unreachable or unresponsive to J. Alan Formalwear, Inc.’s communications, your rights to the merchandise will similarly terminate.

*Free suits earned as part of a wedding group may be ordered as early as the Tuesday following the event, up to 4 weeks following the event date.  After more than 4 weeks following the event date the free offer will be considered expired and will only be ordered at the discretion of a J. Alan Formalwear, Inc. representative.  Free suits earned with a group rental or promotion that are not ordered within 180 days (4 months) shall be considered abandoned and all rights to free merchandise by the customer will be terminated.

*COUPONS, SALES & DISCOUNTS:  All coupons, sales and discounts are not able to be used in combination.  When multiple options are available, the least expensive option for the customer will be used.  There may be exemptions to any sale, discount or coupon offer.  Any items returned may effect the original sale pricing if the items were purchased as a set or during a multiple item sale and the price will be adjusted accordingly.  Please ask a consultant for full details of any sale, discount or coupon offer.
